Hello all,

Thank you for everything that you are doing. This site is great help.

My case is at the reconsideration stage. Called the SSA customer service and was told that case was returned to the local office with annotation "unable to make determination". Does anyone know what does that mean specifically?

Denial, approval, or them being just confused as I am  Smiley

Thank you. Keep up the good work. Power to the People!

My guess is that it means just that they need more info.

The next step might be to send you to a Medical and/or Mental CE...no worrie big grin

inxs,

Welcome to the site.  I agree with Jane, it sounds like there was not enough "development" of your file for a decision to be made.  You will likely hear soon about different forms you need to complete or an exam you must attend.

Hi inxs:

And Welcome. I did a little exploring about the “unable to make decision” notation and found that it refers to a “No determination” claim, which means the DDS has closed the claim in their office and do not expect to get it back. There are several reasons for being coded as “no determination”: DDS has reviewed the evidence and finds the original decision has not changed; DDS determines a technical decision is required from the local SSA office; the local office recalls the claim for technical reasons….

It is probably important you call your local office and find out why your claim has been coded “no determination”.  A “no determination” claim can be reactivated, and the sooner you know the reasons behind it, the sooner you can get it reactivated if possible.

Good luck, and please let us know what you learn.

Thank you all so much for your comments. I did call the local office to inquire and a rep was curious as to how I found out about the code. I said that it was provided to me by their 1800. She kind of chuckled. I guess that's a  no no or something. What's up with secrecy Smiley Feels like I need a TS clearance to find out about my case.....

Anyhu, I said that I was concerned that the case was denied and she said that it remains pending.
I am debating whether to go ahead with retaining an attorney as my tolerance for the whole process is right about 0.
I have the retainer filled out just need to  mail it in........
 Comments, suggestions always appreciated.

Thanks....

Pati,

Thank you for taking the time to research that.  I learned something new once again.

inxs, it sounds to me like you need to push a bit more as there has to be a reason behind the code.  Once you find out, it will make the decision of hiring an attorney a lot more clear.

Hello all. Had a psych eval last week.
Appointment lasted about 2 hours. I guess he went over the appointment time by 15-20 min. Does that mean anything?
He said I gave him a lot of info. Feedback is appreciated.
Thank you guys.

It is good news to hear he was thorough and felt that he had what he needed to give a full report.  That said, it is impossible to know what he thought until the report is submitted.  I will be keeping my fingers crossed.

Glad you got through that long visit! It is positive that the doc spent so much time to thoroughly examine you...it might help to make notes of anything you can remember, just in case you need it for reference later.
Please keep us posted!!

Hello all,

Hope you guys are doing well. Quick question. Is it a normal procedure for ssa wanting to talk to spouse about my health condition? Does that mean anything in terms of them finally making a decision? Any feedback is appreciated. Tx.

It is quite common for social security to either speak with or have a third party complete a form about you and your health.

I am not sure your diagnosis but this seems to happen more often in mental health conditions and seizure disorders.

Here is the form they use:  http://www.ssd-forms.com/SSDFacts/SSA-3380-BK.pdf .  It is likely a lot of the questions your spouse was asked are on this form.

You can read more about it here under letter D :  https://secure.ssa.gov/poms.nsf/lnx/0422511011

The good news is that they are working your case and hopefully getting close to submitting it to medical for a decision.
