hi. I have schizophrenia. I just got denied for my disability claim. They said they did not find me disabled at any date for the past 3 years. This is ridiculous because I had a hospitalization where I was declared gravely disabled. How can the government be so blatantly dishonest?

I am sorry you got denied Gabe.  I have reviewed your previous posts and the absolute best advice I can offer is to get an attorney.  They understand this process and will tell you if your case is strong enough for an appeal and the best way to go about it.

Hello Gabe, I'm sorry to hear about your denial.  I agree with Marci, to hire an attorney.  For me, if you read my "story," it was the best thing I did for myself.  Please try to research the law firms out there that represent SS folks like us.  You'll want to hire a firm with a solid reputation and not an ambulance chaser.  Good luck to you!

     You received some very good advice about hiring a disability lawyer. I do not think I would have been able to win my case without one. I am so sorry you got denied, don't give up, get yourself a lawyer, and I will be praying to the SS Gods for you  pray

Reminds me of my denial. I had 3 heart attacks, 8 angioplasties and 2 hospitalizations with congestive heart failure in a 10 year period but my last denial was because "there was no evidence of a heart condition."

I know it's frustrating but good luck to you.

Gabe you poor thing! I think we all understand your disappointment and frustration. But with in addition to the nature of your condition, it must be very frightening to navigate this crazy system alone.  I absolutely agree with everyone to obtain a REPUTABLE LAW FIRM.  I cannot stress "LAW FIRM" enough.  Do not hire a advocate or representative because although they can legally represent you, they are not educated and licensed to practice law.  You need someone who is well versed in the law. 
About 15 years ago I worked for a social security disability law firm, so when my father needed disability at 61, I helped him and he got it first time around.  But, for myself, I had to navigate my own case through the ALJ Hearing level and finally won after 2.5 years.  I temporarily hired a non-lawyer before the hearing, but dismissed them rather quickly when I realized I had more knowledge in the area of law than they did.  I DO NOT recommend you represent yourself though.

Good Luck and stay in touch.  I wish I would have found this forum way earlier! What a support system for so many!!!

I can only echo the idea that you need to speak with a good attorney or non-attorney representative.  I have not read your previous posts but can tell from this post that you are too emotionally involved to be able to handle the bureaucracy of SSA.  This is not a condemnation, just a fact.  Most people who face the SSA machine are too emotionally involved.  They cannot see the forest for the trees. 

SSA's determinations are not a matter of honesty/dishonesty, just an interpretation of their rules.  A good representative will be able to sort through what is important and what is not.

That said, if properly documented, Listing 12.03 is one of the easier Listings to meet.  But all of the provisions in a specific section must be met.   One hospitalization, no matter how grave the situation may have been, may not meet the durational requirements.  http://www.ssa.gov/disability/professionals/bluebook/12.00-MentalDisorders-Adult.htm#12_03 is suggested reading but be cautious about trying to interpret the Listing – let someone who is versed in SSA law do the interpretation.
