How long does it normally take to hear back from ODAR to see if your decision was favorable or not.....OTR was sent to review on June 13, 2012. At this time I havent heard anything from my attorney or ODAR.

What was the basis for your On The Record (OTR) request?  I.e., how do the conditions you listed prevent your working? 

Epilepsy usually meets Listing 11.02, or 11.03 or it does not – very few cases do. 

Shunts are not an uncommon treatment for hydrocephalus and unless the shunt is not working properly or otherwise has caused loss of mental or motor functioning, do not restrict most work activity. 

To answer your question, different ODAR’s have different turnaround times.  This may be a good question to ask your attorney.   You may not hear anything from ODAR about your OTR request.  It is likely that the next correspondence you (and your attorney) will receive will be your notice of Hearing date.  At that time you will be able to prove that the medical evidence supports your alleged restriction of work function; function so restricted as to prevent your performing even simple, unskilled, sedentary, work.

Additional Info: My Different Perspective comes from a lifetime of being near, working with and for those with disabilities, working for the Easter Seal Society, working for the Disability Determination Services (20+ years) and working as a case assistant to an attorney who, until he retired, worked on SSA disability cases exclusively and have attended approximately 185 Hearings. Sorry DP but I can really not understand much of the lingo of Social Security or any other stuff like that so thats probably why I hired an attorney as soon as I could but on those 11.02 and 11.03 for seizures your saying that people just dont get approved for seizures or rarely? Thanks

I have had 5 shunt revisions due to malfunction. My last MRI which was done Oct 2011 showed major damaged scar tissue from previous surgeries. My flat out told me that I had brain damage due to the hydrocepulus. I have impairment in my left hand :z=-9.83..its hard for me to grasp things and sometimes my hand will go numb for periods of time. My memory is considered severly Impaired. Its hard for me to even remember certain things that happened less than a week ago. I recently got help to do a congressional inquiry on my case and I believe that with my recent hospital stay in October of 2011 led them to review my case for an OTR.

Kuma, my attorney did tell me at the very begining that Epilepsy is very hard to prove as a disability. He had to review my medical records indepth before he would except me as a client.

I also got help from my local congressman. I called them last week in regards to the OTR  review and they told me that is could possibly be with a staff attorney or a decsion writer. I'm still so confused on that part.

Update...got a call from my attorney this morning. Favorable decision!! She said I should get a letter from the judge here shortly. Does anyone no how long it will take and when I will start receiving benefits??
