« on: August 10, 2017, 10:44:12 AM »
ok i just found out the judge made a decision. but i do not know what it is. due to the Ac is reviewing my file. so my ? is why are they reviewing the file first? is it  because it has been remand or is because the decision that has been made is different? i am sorry for so many ? just trying to understand.

My response is pure speculation, and I am a little confused by the question...

If your file is actually in AC (Appeal Council), that would indicate that your representative already received a denial, and then submitted the appeal.

Or the claim could have been sent to Quality Review, but of course those are different initials.

Did you check with your rep for any updates?

Los Angeles, CA

Short Version: Filed in June 2012 at age 46; major depression + general anxiety. Denied all the way through. Fed district court remanded, 2nd hearing delayed twice (11 months total delay). Bench approval at remand hearing in March 2017. Took six months to receive most of back pay.

If they change your onset date without you agreeing to an onset date change, then it is considered a "partially favorable" decision.  You will have a right to appeal the decision - but appealing reopens the entire decision so it can be turned into a denial.

Did you officially adopt grandson?  Or are both of his parents disabled or deceased?  https://www.ssa.gov/people/kids/  read the section labelled "Benefits for Grandchildren" under the Parent's Place tab.

If they change the onset date for Txgirl47 from 2010 to 2012 (partially favorable decision) she will loose 2 years of back pay but other than that will it effect her in any other way???

I don't want to sound like loosing 2 years of back pay is trivial, it's not.....but considering the fight she has fought hopefully in the big picture its a small price to pay.

It depends.  Sometimes benefit amount is effected by a newer EOD.

Yes Lit Love as mine was.  My EOD was changed by 4 years 6 months. It changed by close to $200.
