Time from Remand to ALJ
« on: August 26, 2012, 05:30:35 AM »
The Appeals Council can decide that the judge made a technical error or failed to consider some of your medical evidence, resulting in the need for a remand. Please let us know how long it took before you were able to see the ALJ again.

The delays are most often caused by your attorney having scheduling issues.

Remanded hearing are given priority for scheduling, so the wait is less than the initial wait for the first hearing.

That being said, there are many variables that can affect the scheduling, such as: attorney's availability, ALJ wanting more VE/ME testing, exisitng ALJ's schedule, etc....

I would advise you to constructively use this waiting period to really concentrate on the issue(s) that your case was remanded on.  Remember that you are still considered in the initial stage of the Social Security Disability Process and you HAVE TO PROVE that you are disabled to the ALJ.

Hope this helps....
